1. Acceptance of terms

These Terms of Service ("Terms") form a legal agreement between you and YM Pharma Group Ltd. By creating an account, subscribing, or using YourTracker (the "Service") in any way, you agree to these Terms.

If you don't agree, please don't use the Service.

3. Eligibility

To use YourTracker, you must:

• Be at least 18 years old
• Have the legal capacity to enter into a binding agreement
• Provide accurate, current, and complete account information
• Not be prohibited from using the Service under applicable law

YourTracker is designed for people taking GLP-1 medications (such as Mounjaro or Wegovy) that have been prescribed by a healthcare professional. We do not provide medication or medical advice.

4. Your account

You're responsible for:

• Keeping your password secure and confidential
• All activity that happens under your account
• Notifying us immediately if you suspect unauthorised access
• Ensuring the information in your account stays accurate

You may not share your account, sell it, or allow anyone else to use it.

5. Subscription and payment

YourTracker offers a paid subscription. By subscribing you agree to:

• Pay the current subscription fee, as shown at checkout
• Automatic renewal at the end of each billing period (monthly or annual)
• Billing in GBP (£) unless otherwise specified
• Payment processed by our payment provider, Stripe

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.

We may change subscription prices. If we do, we'll give you at least 30 days' notice before the new price applies to your next renewal. You can cancel before then if you don't agree.

6. Trials and refunds

We offer a 30-day free trial. No payment is taken during the trial. You can cancel at any time during the trial with no charge.

After the trial, if you continue, you will be charged. We don't offer refunds for partial months, but you can cancel any time and keep access until the end of your current period.

If you believe you've been incorrectly charged, contact [email protected] within 14 days and we'll investigate.

Statutory rights: These Terms do not affect your statutory rights under UK consumer law, including the Consumer Rights Act 2015.

7. Acceptable use

When using YourTracker, you agree not to:

• Use the Service for any illegal purpose
• Upload content that's defamatory, hateful, or infringing on others' rights
• Attempt to reverse-engineer, hack, or disrupt the Service
• Scrape or harvest data from the Service
• Impersonate someone else or provide false information
• Resell or commercially exploit the Service without our written permission
• Use the Service to give medical advice to others

We may suspend or terminate your account immediately if you breach this section.

8. Medical disclaimer

The content and features in YourTracker are for informational and personal tracking purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult your pharmacist, GP, or other qualified healthcare professional about your medication
• Never disregard professional medical advice because of something you read or tracked in YourTracker
• If you experience a medical emergency, call 999 immediately or NHS 111 for non-emergency medical advice
• Never ignore or stop your prescribed medication based on app data alone

We do not verify the accuracy of data you enter. We're not liable for health outcomes resulting from reliance on information tracked in the app.

9. Your content

Anything you enter into YourTracker — your weight, meals, photos, notes, etc. — remains your property.

By using the Service, you grant us a limited, non-exclusive licence to store, process, and display this content solely to provide the Service to you (including backups, analytics in anonymised form, and account recovery).

You can export or delete your content at any time from your account settings.

10. Our content

The YourTracker software, design, branding, content, and trademarks are owned by YM Pharma Group Ltd and protected by UK and international copyright, trademark, and other intellectual property laws.

You get a limited, personal, non-transferable licence to use YourTracker while your account is active and in good standing. You may not copy, modify, distribute, or create derivative works from our software or content.

11. Termination

By you: You can cancel your subscription or delete your account at any time from your account settings.

By us: We may suspend or terminate your account if:

• You breach these Terms
• Your account poses a security or legal risk
• You haven't paid an overdue subscription fee
• We're required to by law
• We decide to discontinue the Service (in which case we'll give reasonable notice and prorated refunds)

On termination, your access will end. We'll delete your personal data within 30 days, as described in our Privacy Policy, except for records we must keep for legal reasons (e.g. billing records).

12. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that can't be excluded or limited under UK law

Subject to the above, we will not be liable for:

• Indirect, consequential, or special losses
• Loss of profits, revenue, business opportunity, or goodwill
• Loss of data (though we back up responsibly, we recommend exporting regularly)
• Losses arising from reliance on app content or data as medical advice

Our total liability to you in any 12-month period is limited to the greater of: (a) the amount you paid us for the Service in the 12 months preceding the claim, or (b) £100.

13. Changes to these terms

We may update these Terms from time to time. For material changes we'll email you and display a notice in the app at least 30 days before the changes take effect. Continued use after that means you accept the new Terms.

Minor, non-material changes (like a typo or formatting fix) may be made without notice.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the exclusive jurisdiction of the courts of England and Wales.

If any part of these Terms is found invalid or unenforceable, the rest remain in effect.
